WAIVER OF LIABILITY AND INDEMNITY
DINOKENG GAME RESERVE - NORTH

IN CONSIDERATION of being permitted to 1] access properties (“the DGR Properties”) and/or 2] access or utilize facilities and/or lodging (“the DGR Facilities”) and/or 3] utilize any vehicles, equipment, furniture, fittings or any other similar items (collectively “the DGR Equipment”) located within the Dinokeng Game Reserve (“the DGR”), or otherwise being permitted to [4] partake in any game and/or bird viewing activities,  hiking activities, boat cruises and/or any other forms of recreational, sports, leisure or tourism activities offered within the DGR (collectively “the DGR Activities”), I, the undersigned, HEREBY:

1.            declare that I enter the DGR Properties and DGR Facilities and utilize the DGR Facilities and DGR Equipment at my own risk.

2.            acknowledge that the right of admission to the DGR Properties and DGR Facilities is and will remain strictly reserved.

3.            acknowledge and agree that the DGR Activities or use of the DGR Facilities or DGR Equipment may involve the risk of serious injury, and or death,  and or illness, and or infections, and or inconvenience, and or damage to property, as a consequence of which I hereby assume full responsibility for the risk of bodily injury, death, or damage to property whether or not due to negligence while partaking in any of the DGR Activities or while using the DGR Facilities or DGR Equipment.

4.            release, waive, discharge and agree to indemnify and hold harmless 1] The relevant Land/Product owner, 2] and/or the DGR North Management Authority, and/or 3] Dinokeng Game Enterprises Limited (collectively “the DGR Entities”), their agents, employees, assigns, officers, executive members, shareholders and/or directors, for and against all liability, costs or damages, including attorneys' fees incurred defending any claim whatsoever, arising out of any claim, injury, or occurrence resulting from loss of life, personal injury or damage to property while accessing the DGR Properties or DGR Facilities or while utilizing the DGR Facilities or DGR Equipment or while partaking in the DGR Activities.

5.            acknowledge that this Waiver of Liability and Indemnity shall bind me personally, my executors, heirs, assigns and next of kin and be applicable to any and all accidents, injuries, or other similar events and I hereby personally accept all liability and responsibility for my actions.

6.            declare that I also hereby assume liability under and in terms of this Waiver of Liability and Indemnity for or on behalf of my minor children, my guests, my agents and my employees who access the DGR Properties or DGR Facilities or who utilize the DGR Facilities or DGR Equipment or who partake in the DGR Activities.

7.            undertake to use the DGR Equipment and the DGR Facilities only for their intended purpose.

8.            acknowledge that I have read, understand, and voluntarily sign this Waiver of Liability and Indemnity, and further understand that no oral representations, statements, or inducements apart from this document have been made.

9.            consent to the process of my personal information or that of my minor children in accordance with the provisions of the Protection of Personal Information Act, 2013, for all purposes related to this Waiver of Liability and Indemnity.
